QIC US Management, Inc. or one of its affiliates (collectively, "we", "our", "us", and "QIC") provides wireless internet connectivity service (the “Service”) for the enjoyment of the User only, subject to the following Terms and Conditions. THE SERVICE IS AVAILABLE FOR USE ONLY BY USERS WHO ARE AT LEAST EIGHTEEN YEARS OF AGE. BY ACCESSING OR USING THE SERVICE, YOU REPRESENT TO QIC THAT YOU ARE AT LEAST OF THAT AGE. QIC makes no representations that the Service will be free from interruption or from malware, viruses or other harmful code, or from unauthorized access or use and QIC assumes no liability for any of the foregoing. The User is responsible for implementing proper security measures on his or her device and storage media used to access or use the Service (“Device”). QIC may terminate the Service at any time, without warning, notice or liability and in its sole discretion. QIC takes no responsibility for any content that is posted on or accessible the Internet. THE USER AGREES THAT UNDER NO CIRCUMSTANCES SHALL QIC BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND, OR ANY OTHER DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION, DAMAGES RELATED TO THE USER’S USE, MISUSE, RELIANCE ON, INABILITY TO USE AND INTERRUPTION OF THE SERVICE, ANY LOSS OF USE, SALES, DATA, GOODWILL OR PROFITS, BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT FORESEEABLE OR WHETHER OR NOT QIC HAS BEEN ADVISED OF SUCH POSSIBILITY. QIC may refuse or discontinue access to the Service to anyone for any reason, including without limitation, any violation of these terms and may report unauthorized use to any authority that QIC deems appropriate. The following uses, but not limited to the following, are strictly prohibited: use that violates or is in furtherance of any violation of any local, state or federal law; use that violates any intellectual property right of any person or entity; illegal file sharing; use that involves pornographic or other sexually explicit content; use that promotes the damage or harm to or harassment of another person or property; use to communicate unsolicited commercial email, unsolicited bulk mail or other similar communications; use to gain unauthorized access to any other computer or device or another network; use to collect, or attempt to collect, any personal information from or about third parties without their express permission or knowledge; use to re-sell or distribute the Service without the written consent of QIC; use which disrupts or degrades the use of the Service or the Internet, including any excessive use of bandwidth as determined by QIC; or use in a business whereby the Service is used as a means of communication. QIC collects data regarding the use of the Service; the sites and functions accessed; the nature of the access or use; the type or brand of the Access Device; applications, operating system or programs used on the Access Device; and other similar information. QIC also may collect the name of the Access Device as assigned by the User. QIC uses the information gathered to maintain and deliver the Service to the Users; to research and analyze Service usage in order to maintain, protect and improve the Service and to identify general trends to enhance QIC and property offerings; and to ensure the technical functioning of the Service. QIC employees do not intercept or store the content of any communications or files a User sends or receives. QIC may share information gathered with other companies or individuals outside of QIC. QIC also may share such information as may be required or appropriate in connection with any governmental investigation or inquiry or as otherwise required by law, and we may not be permitted to notify you when we do so. By agreeing to these Terms and Conditions and using the Service, the User hereby consents to QIC’s collection of the Access Device name as well as data regarding the User’s use of the Service. QIC reserves the right to modify these Terms and Conditions at any time. It is the User's responsibility to thoroughly read and review these Terms and Conditions before accessing or using the Service. By accessing or using the Service, the User agrees and takes responsibility for having read the Terms and Conditions above and understands and agrees to abide by such Terms and Conditions.
